General Terms and Conditions
of OPER BURG GARS GmbH
Scope of Application
The General Terms and Conditions (GTC) regulate the legal relationships between OPER BURG GARS GmbH (hereinafter “OBG”) and visitors of all events offered by OBG. They form part of the contract concluded through the purchase of tickets.
OPER BURG GARS including Own Events
1. Venue
Events at Burg Gars take place outdoors (open-air). Events of the KulturBURG are held in the function hall. An exception is the summer concert “Stars in Gars – Unterreiner & Friends” 2025, an event of the KulturBURG, which will take place on the open-air stage.
2.1 Ticket Prices
Only the ticket prices and discounts listed on the OBG website at the time of purchase apply. Ticket prices include 10% VAT. Shipping fees, program booklets, food and beverages, and similar offers or services related to the events are generally not included in the ticket price.
2.2 Discounts
Tickets at reduced prices are valid only in conjunction with a valid ID or document justifying the discount. If the ID or document cannot be presented at the entrance, the difference to the full ticket price must be paid. Different discounts cannot be combined. Discounts are only available in advance and cannot be claimed at the box office on the day of the event. Discounts cannot be applied retroactively to already purchased tickets. For external events, only full-price tickets can be purchased through OBG. Reduced-price tickets and wheelchair-accessible seats cannot be booked online but only by phone, in writing, or in person at the OBG ticket office.
3. Ticket Sales
3.1 Ticket Orders
Tickets can be purchased online, in writing, by phone, directly at the ticket office, or at the box office on the day of the event. If no credit card details (card number, expiry date, CVC) are provided at the time of order, orders become binding only upon receipt of payment.
If ordering without immediate payment, a reservation confirmation will be sent by email or post within a few days. The stated amount must be credited to our account within the payment period indicated on the invoice. If payment is not received on time, we cannot guarantee the maintenance of your reservation. For organizational reasons, the payment method “advance payment” is only available up to three weeks before the respective event.
3.2 Payment Methods
Payments can be made at the ticket office and box office in cash or by debit card, online, via the ticket office and at the box office by credit card, or (for phone or written orders) via bank transfer. Other payment methods (PayPal, check, etc.) are not offered or accepted by OBG.
Only VISA and Mastercard are accepted. The corresponding invoice amount will be charged to your credit card account.
3.3 Shipping – Reservation for Pickup
Sending tickets by email is free of charge. For postal delivery, a fee of €4 per order applies. After prior payment, tickets can also be reserved for pickup at the ticket office or on the day of the event at the box office, exclusively for OBG’s own events.
3.4 Invoicing
The ticket itself serves as an invoice. Upon request, a separate invoice can also be issued.
3.5 Self-Printed Tickets
Tickets are only valid for the event printed on them, must be presented at the entrance, and will be invalidated upon first control. Any reproduction, copy, alteration, or electronic processing of a ticket is strictly prohibited.
3.6 Opening Hours of Ticket Offices
The ticket office (Hauptplatz 80, 3571 Gars am Kamp) and telephone sales are open at times indicated on the website. The box office at Burg Gars opens two hours before the start of events.
3.7 Resale of Tickets
Commercial resale of tickets is permitted only to OBG sales partners and is prohibited without prior consent. OBG may refuse to sell tickets or issue replacement tickets to companies or individuals who resell tickets commercially without consent or operate corresponding networks.
Ticket delivery will take place after payment (credit card or invoice). If payment is not received on time, the order will be canceled, and the tickets will be released for general sale.
OBG assumes no liability for the validity of tickets from other providers, their services, or additional charges.
Use of OBG-owned material (text, audio, image, and video) for promotional purposes is only permitted for sponsors and sales partners with image credits.
Private resale of tickets without profit intent is generally permitted. Admission to events is only granted with a valid ticket (original).
OBG assumes no liability for the validity of tickets from private sellers and advises against purchasing tickets via unauthorized online platforms. Verification of ticket validity is not possible in such cases. The risk lies entirely with the ticket purchaser.
OBG may refuse to sell tickets or issue replacement tickets to individuals reselling for profit.
Resale of tickets at the event venue is prohibited.
3.8 Exchange – Refund
Purchased tickets cannot be exchanged or refunded, including in cases of justified non-attendance. Exceptions may be granted in cases of hardship at OBG’s discretion, without entitlement.
Changes in cast, program, or performance sequence do not entitle ticket holders to exchange or refund. In the event of a change, OBG will make reasonable efforts to inform ticket holders.
The right of withdrawal under distance selling according to §11 FAGG does not apply to ticket purchases, as these are leisure services within the meaning of §18(1) Z 10 FAGG.
OBG reserves the right to provide seats other than those printed on the ticket for organizational reasons, within the same or a better category.
3.9 Lost Tickets
In the event of a lost ticket, a replacement ticket may be issued once. The replacement must be requested in writing and can only be issued if the ticket holder can prove or credibly demonstrate which ticket was purchased. In case of double booking, the original ticket holder takes priority.
4. Changes, Interruption, or Cancellation of Events
OBG reserves the right to make last-minute changes to cast, program or start of the performance, as well as to postpone or cancel events. Only official communications from OBG are binding. OBG assumes no responsibility for information in unauthorized publications.
Events may be interrupted or canceled for personnel (illness or absence of irreplaceable performers), technical (general power outage, etc.), political (bans by decree), weather-related, or force majeure reasons.
Performances on the opera stage of Burg Gars are outdoors and thus exposed to the weather. The unique atmosphere offered is so appealing to our audience that by far the majority of our guests are happy to accept a certain weather-related risk. OBG is obliged to perform as long as this is possible without danger or severe impairment for the audience and performers.
OBG is therefore endeavoring to carry out performances and concerts in full even in inclement weather. Please note that performances may take place in rain. Warm and rainproof clothing is recommended. Delays or interruptions may occur depending on weather conditions.
In the event of an interrupted performance, the event is still considered to have taken place if at least the first act of a performance or the regular first part of a concert has been performed. This comprises at least 45 minutes, usually not less than 60 minutes. In such cases, no exchange or refund of tickets is possible.
If the interruption occurs before this duration or if a performance is entirely canceled, tickets may be exchanged for equivalent replacement dates. These may be further performances during the current season or the following year’s opera production. If not possible, the ticket value minus any fees will be refunded. Exchanges can only be made via the ticket office with presentation of original tickets and invoice. Refunds are issued exclusively through the respective point of sale.
Due to COVID-19 regulations, event dates may be rescheduled. Tickets cannot be exchanged or refunded except in case of cancellation. Persons showing COVID-19 symptoms or under quarantine orders may not attend. The organizer reserves the right to change programs or dates within reasonable limits. No expenses (hotel, travel, etc.) are reimbursed for cancellations, postponements, or program changes beyond the organizer’s control.
5. Event Rules / Information
5.1 Admission
Admission is generally 30 minutes before the event starts. For technical, dramaturgical, or weather-related reasons, admission time may change. Entry is only allowed with a valid ticket (original).
Upon start of the event, the right to the booked seat expires for safety reasons and consideration of performers and other visitors. Latecomers may only enter during intermissions or accompanied by staff. Occupying a seat other than that indicated on the ticket is not allowed. Unauthorized seat changes may incur a fee or result in removal from the seat or the event.
5.2 Children’s Admission
Children require their own ticket/seat regardless of age or size. Admission is conditional on the presence of an authorized accompanying person, who must ensure no disturbance to other guests. Exceptions apply to events specifically designated for children.
5.3 Items Allowed / Prohibited
For safety reasons and to ensure smooth admission controls, the following rules for items brought in apply:
Allowed:
- Bags (may be checked by the staff at the entrance)
- Bottles (max 0.5 L) or plastic cups
- Seat cushions, blankets and items from the shop
Prohibited:
- Glass bottles, glasses, thermoses, cups and cans
- Purchased food
- Professional photo/video equipment (including telephoto lenses, tripods, camera bags) and audio recording devices
- Selfie sticks, laser pointers, laptops, tablets (except mobile phones)
- Suitcases, trolleys, helmets, child seats, booster seats and any
- other bulky items
- Umbrellas (must not be opened in the stands)
- Knives or any items defined as weapons under Austrian law
- Animals (except certified assistance dogs, prior registration required)
Bringing any food or drink into the festival area is prohibited, except for baby/child food and items purchased on-site.
6. Audio and/or Video Recordings
Due to copyright and potential disturbances, audio/video recordings, including via smartphones, are prohibited. Non-compliance may result in exclusion without refund.
By purchasing a ticket, visitors consent to the use of images of themselves in photos, TV and video recordings by OBG or authorized third parties.
7. House Rules
Visitors may be denied entry if there is reason to believe they will disturb the event or other visitors. Entry may also be denied if house rules were previously violated. Persons obstructing ticket sales, in particular by attempting to offer or resell tickets privately on the Burg Gars premises, may be removed from the site.
Mobile phones, pagers, and audible devices must be switched off.
Smoking is only permitted outside stage and audience areas.
Animals, except certified assistance dogs, are not allowed on the Burg Gars.
Items of any kind found on the Burg Gars premises must be handed in at the box office or ticket office. Any loss of items must also be reported there.
Visitors are personally liable for any damage they cause to fixtures, equipment or other facilities on the event area.
8. Data Protection
Both when using our website and when attending events, the privacy of our visitors is of particular importance to us. Further details can be found under the “Data Protection” section.
9. Final Provisions
By purchasing tickets, you accept the general terms and conditions of OBG. Should parts of these general terms and conditions be or become invalid, the unaffected parts remain valid.
If tickets are transferred to third parties and thus new ticket holders, the regulations and obligations in the general terms and conditions remain in force, and the new ticket holder agrees by accepting the ticket.
Oper Burg Gars as a Ticketing Agency for External Events at Burg Gars
Oper Burg Gars GmbH sells tickets for external events at Burg Gars on behalf of and in the name of external organizers. OBG can only sell full-price tickets for external events, and the purchase contract is concluded directly with the organizer. The organizer receives a detailed statement of all ticket sales from OBG.
For external events, points 5.3, as well as 7–8, also apply.
House Rules
for the event area BURG GARS
Am Schlossberg, 3571 Gars am Kamp / Thunau
Oper BURG GARS GmbH (organizer) holds the right of house throughout the entire event area. Acceptance of the house rules is a prerequisite for admission and applies equally to visitors and performers. The present house rules apply throughout the castle grounds.
Part of the castle grounds is used as the event area (stage/audience stands). Alteration and/or damage to parts of the castle, the grounds, the festival area, or the sanitary facilities is prohibited.
Entry with cars or trucks to the entire castle grounds is generally prohibited. Entry permits may be issued by the organizer and must be visibly attached to the vehicle. Parking on the castle grounds is prohibited and may lead to possession disputes as well as possible claims for damages.
Being on the castle grounds is at one’s own risk. Access is only permitted to the designated areas and on marked paths. Climbing or scaling ruins or castle parts is strictly forbidden. Access to all technical rooms, workshops, depots and storage rooms is not permitted. The castle grounds are cleared of snow and ice only during events in winter.
Parents are responsible for their children.
Accidents or damages occurring on the castle grounds must be reported immediately in writing to the organizer.
Visitors are not allowed on the stage. Performers must follow the instructions of Oper BURG GARS during rehearsals.
The castle grounds generally open two to three hours before the start of a performance.
Visitors must follow the instructions of the security staff, fire brigade, emergency services and any announcements.
Visitors and performers entering the castle grounds must behave in a way that does not harm, endanger, obstruct or annoy others. Anyone intentionally or negligently failing to follow instructions may be removed from the premises.
Carrying sharp or dangerous objects, glass bottles, weapons, fireworks, smoke bombs, laser pointers, etc., onto the castle grounds is prohibited. Persons posing a security risk may be denied entry. In case of doubt, the security staff decides on the danger posed by an object or person.
During rehearsals and performances, entrance controls take place. Visitors and performers are obliged to present their entrance authorization (ticket; performer ID) unprompted when entering. Refusal entitles the organizer to deny access.
There is no entitlement to a refund of the ticket price for denied access.
Visitors are obliged to take the seat indicated on the ticket, and the staff will assist if necessary. Standing on seats in the audience areas is prohibited during performances. After the start of a performance, visitors may only be admitted during suitable breaks, taking into account the performers and other visitors; this is at the discretion of the staff. After the start of a performance, latecomers are not entitled to occupy their booked seats.
Marked paths must be used within the castle grounds. If the castle grounds are left, the corresponding ticket must be carried to regain access, otherwise, entry cannot be granted again.
Entrances and exits, emergency, escape, and rescue routes must be kept clear.
During performances, bringing food and drinks into the castle grounds is prohibited. Performers may eat and drink and may also have food and beverages with them during rehearsals. Waste must be disposed of in the designated areas according to operational instructions (waste separation). Violations of this rule may lead to prohibition of bringing food and drinks into the castle grounds. Visitors and performers must dispose of waste in the provided containers.
Bringing dogs is allowed until further notice, expect at events. Dogs must be kept on a leash throughout the castle grounds. Appropriate waste bins are provided for the disposal of excrement. Disposal must be carried out by the respective dog owner. Polluting the castle grounds is prohibited.
Distribution of advertising material, printed matter, etc., is only permitted with the organizer’s prior written approval.
Smoking, the use of e-cigarettes, fire and open lights are strictly prohibited both in the stage and audience areas.
Creating audio or video recordings is not allowed.
Persons entering the castle grounds irrevocably consent to the free use of their image and voice for all current and future media in photographs, live broadcasts, transmissions, and/or audio and video recordings made by the organizer or its agents in connection with the event.
Performances on the opera stage of Burg Gars take place outdoors and are therefore exposed to weather conditions. We therefore point out that performances may take place even in rain. In case of a necessary interruption, the performance is still considered to have taken place if at least the first act of a show or the regular first part of a concert has been performed. This includes at least 45 minutes, usually not less than 60 minutes of playing time. In such cases, there is no entitlement to exchange or repurchase tickets. If the performance is interrupted after a shorter duration or completely canceled, tickets can initially be exchanged for equivalent tickets for an alternative date. This may include further performances in the current season or performances of the opera production in the following year. If this is not possible, the ticket value will be fully refunded. Exchanges can only be processed through the ticket office upon presentation of the original tickets including the invoice. Refunds of ticket prices are made exclusively through the respective points of sale.
Persons not belonging to the group of performers are generally not allowed to access areas reserved for performers or the stage. This applies in particular to artist dressing rooms, the orchestra house, and artists’ lounges, as well as the offices of the management. The presence of external persons during rehearsals requires approval from management.
Performers are liable for culpable damage to the organizer’s property or third-party property provided by the organizer. Costumes, props and stage sets must be treated appropriately and carefully.
These house rules come into effect on September 1, 2023 and are valid until further notice.

We, Oper BURG GARS, aim to provide opera fans and culture enthusiasts with a platform via our social media channels to stay informed about our current events and productions. We invite all users to participate in constructive and stimulating discussions. It is important that these interactions are always conducted with mutual respect and tolerance. We, Oper BURG GARS, also take responsibility to uphold and protect these netiquette rules at all times.
Even though social media is a virtual space, real interactions and discussions occur between people, therefore, we ask users of our social media channels to behave responsibly and fairly. Discriminatory or offensive insults, as well as abusive language, are strictly prohibited. We also do not accept sexist, racist, or derogatory comments on our social media channels. Furthermore, we reject contemptuous, offensive or reputation-damaging comments about individuals. Users should ensure that comments are relevant to the topic and written in a polite tone.
Violation against our Netiquette:
If there is a violation of one or more of our netiquette rules, our social media team may hide or delete such posts or comments after pointing out our rules of conduct. This action should not be considered censorship, as it complies with the general terms and conditions of Oper BURG GARS.
Spam content or references to external URLs/links shared for commercial purposes may also be hidden or deleted after review by our social media team.
